  • TSA Vendor Denies Faking Test of Body-Imaging Software

  • Court OKs warrantless use of hidden surveillance cameras
    warrantless thermal imaging but it has not yet ruled on warrantless cell phone tracking or warrantless use of surveillance cameras placed on private property without permission Yesterday Griesbach adopted a recommendation by U S Magistrate Judge William Callahan dated October 9 That recommendation said that the DEA s warrantless surveillance did not violate the Fourth Amendment which prohibits unreasonable searches and requires that warrants describe the place that s being searched The Supreme Court has upheld the use of technology as a substitute for ordinary police surveillance Callahan wrote Two defendants in the case Manuel Mendoza and Marco Magana of Green Bay Wis have been charged with federal drug crimes after DEA agent Steven Curran claimed to have discovered more than 1 000 marijuana plants grown on the property and face possible life imprisonment and fines of up to 10 million Mendoza and Magana asked Callahan to throw out the video evidence on Fourth Amendment grounds noting that No Trespassing signs were posted throughout the heavily wooded 22 acre property owned by Magana and that it also had a locked gate U S Attorney James Santelle who argued that warrantless surveillance cameras on private property does not violate the Fourth Amendment Credit U S Department of Justice Callahan based his reasoning on a 1984 Supreme Court case called Oliver v United States in which a majority of the justices said that open fields could be searched without warrants because they re not covered by the Fourth Amendment What lawyers call curtilage on the other hand meaning the land immediately surrounding a residence still has greater privacy protections Placing a video camera in a location that allows law enforcement to record activities outside of a home and beyond protected curtilage does not violate the Fourth Amendment Justice Department prosecutors James Santelle

    other health care policies as prescribed by Medicare rules said Mary Greene a St Luke s Hospital representative in an e mail She referred any questions to Medicare Drug prices have also surprised seniors in other parts of the country In Missouri several Medicare observation patients were billed 18 for one baby aspirin said Ruth Dockins a senior advocate at the Southeast Missouri Area Agency on Aging Pearl Beras 85 of Boca Raton Fla said in an interview that her hospital charged 71 for one blood pressure pill for which her neighborhood pharmacy charges 16 cents In California a hospital billed several patients 111 for one pill that reduces nausea for the same price they could have bought 95 of the pills at a local pharmacy said Tamara McKee program manager for the Health Insurance Counseling Advocacy Program at the Alliance on Aging in Monterey County Calif who handled at least 20 complaints last year from Medicare beneficiaries about excessive hospital drug bills The most recent government statistics show the number of observation claims that hospitals submitted to Medicare rose 46 to 1 4 million from 2006 to 2010 and the number of cases lasting longer than 48 hours more than tripled The American Hospital Association in a 2010 letter to Medicare officials said several factors explain that growth including increasingly restrictive Medicare criteria for the hospital admission and rising use of audits to monitor hospital decisions and billing In addition it said physicians sometimes try to keep seniors in the hospital because they may not be well enough to be home even when they re not sick enough to be admitted I don t blame the hospitals said attorney Gill Deford at the Center for Medicare Advocacy based in Connecticut which has filed a class action lawsuit against the federal government on behalf of observation patients who because of their observation status become ineligible for Medicare coverage for nursing home care when they leave the hospital The lawsuit seeks to either eliminate observation status or require hospitals to tell patients when they re admitted for observation and allow them to appeal the designation Observation status is a big money saver for the Medicare program he said Medicare officials recommend to hospitals but do not require that patients remain under observation for no more than 24 to 48 hours After that the patients should be switched to inpatient status or discharged the officials recommend But patients can linger in observation for several days and often don t know they haven t been admitted Difference in pricing Since the program does not limit the prices for drugs that Medicare doesn t cover that can create an opportunity that hospitals might find hard to resist Hospitals use their pharmacies to help generate revenue to subsidize the other operating costs of the facility said Miriam Mobley Smith dean of the College of Pharmacy at Chicago State University She said the upcharge is based on numerous factors including personnel insurance and facility costs I

    managed by a trustee I don t manage them I don t even know where they are That trustee follows all U S laws all the taxes are paid as appropriate all of them have been reported to the government there s nothing hidden there Yet even longstanding politicians from these offshore tax shelters admit they don t fully understand what is happening within their domains I first learned of Jersey s tendency toward secrecy when it banned me from the island while researching a book investigating whether police officers and politicians were driven from their jobs while attempting to investigate decades of alleged rape torture and the possible murder of children at one of the island s most notorious orphanages Haut de la Garenne The UK authorities have since invited me back but only after detaining me for more than 12 hours in the basement of Heathrow Airport going through my papers and enduring the glare of subsequent national press coverage from the BBC to the Guardian This past month members of both the UK and Jersey parliaments began a campaign to find out exactly how Jersey is run Its medieval status as a so called peculiar possession of the Crown endows it with some curious traits redolent of a modern day special purpose vehicle Although it ultimately answers to the Queen it acts autonomously printing its own currency pegged to the British pound and presiding over its own parliament judicial and financial systems In a speech last month UK Member of Parliament John Hemming bemoaned a lack of transparency and democracy in Jersey the jewel of the Channel Islands noting that the UK as a whole faces a really big problem particularly in matters involving a lot of secrecy A former Jersey senator Stuart Syvret appealed to the

    Jersey s former health minister Stuart Syvret who backed the victims and police in the 2008 investigation was also sacked He was imprisoned last year for publicising a serious allegation on another unrelated matter which for legal reasons cannot be described Syvret told the Telegraph Jimmy Savile abused children in Jersey I believed his victims Just as I believe the two people who told me of child abuse by another TV personality this week confirmed as Brambell on Jersey from the Seventies Just as I believed those who told me that the authorities of the day had ignored their complaints of years of abuse by others in Jersey s children s homes Savile is dead so why must we dig into the sorry and wretched details Because the crucial feature of this case is not so much the individual crimes as bad as they are and as damaging for the victims it is instead what I call the culture of cover up As a result of the fallout from the investigation into Haut de la Garenne the public was left believing that Harper and his team had over reacted to the abuse allegations Yet seven people have since been convicted of abuse as a result of the inquiry and to date compensation has been agreed for over 100 victims with many more civil cases pending Police had allegations against 150 individuals many never adequately investigated including Savile There are at least four known victims of Savile from Jersey and at least one disclosed their abuse to police in 2008 yet it is only now that their claims are being considered seriously Jersey Police have confirmed that one victim made accusations against Savile in 2008 But for reasons that are still unclear it is thought the allegations were not typed up into the statements seen by senior officers It is believed that Savile denied ever having been to Haut de la Garenne and threatened to sue a newspaper for claiming that he visited the home Although the Metropolitan Police are co ordinating inquiries across Britain into Savile s alleged crimes it is individual forces that are expected to examine them in detail Carrie Modral says few of the victims trust Jersey s police to do so That window of opportunity closed when the Jersey establishment got rid of the good cops she says It was a member of the Jersey Care Leavers Association who told police in 2008 that she was sexually abused at Haut de la Garenne by Savile The news about Savile has brought it all back she is in great distress says Modral Savile visited regularly not just Haut de la Garenne but other children s homes on the island He wasn t the only visitor The victim has named another household name who visited the home with Savile She added I can tell you that two staff members who abused her at another home have been imprisoned and the authorities have agreed financial compensation for her But
