  • Thomas Jefferson - Second Inaugural Address
breathing an ardent love of liberty and independence and occupying a country which left them no desire but to be undisturbed the stream of overflowing population from other regions directed itself on these shores without power to divert or habits to contend against it they have been overwhelmed by the current or driven before it now reduced within limits too narrow for the hunter s state humanity enjoins us to teach them agriculture and the domestic arts to encourage them to that industry which alone can enable them to maintain their place in existence and to prepare them in time for that state of society which to bodily comforts adds the improvement of the mind and morals We have therefore liberally furnished them with the implements of husbandry and household use we have placed among them instructors in the arts of first necessity and they are covered with the aegis of the law against aggressors from among ourselves But the endeavors to enlighten them on the fate which awaits their present course of life to induce them to exercise their reason follow its dictates and change their pursuits with the change of circumstances have powerful obstacles to encounter they are combated by the habits of their bodies prejudices of their minds ignorance pride and the influence of interested and crafty individuals among them who feel themselves something in the present order of things and fear to become nothing in any other These persons inculcate a sanctimonious reverence for the customs of their ancestors that whatsoever they did must be done through all time that reason is a false guide and to advance under its counsel in their physical moral or political condition is perilous innovation that their duty is to remain as their Creator made them ignorance being safety and knowledge full of danger in short my friends among them also is seen the action and counteraction of good sense and of bigotry they too have their antiphilosophists who find an interest in keeping things in their present state who dread reformation and exert all their faculties to maintain the ascendancy of habit over the duty of improving our reason and obeying its mandates In giving these outlines I do not mean fellow citizens to arrogate to myself the merit of the measures That is due in the first place to the reflecting character of our citizens at large who by the weight of public opinion influence and strengthen the public measures It is due to the sound discretion with which they select from among themselves those to whom they confide the legislative duties It is due to the zeal and wisdom of the characters thus selected who lay the foundations of public happiness in wholesome laws the execution of which alone remains for others and it is due to the able and faithful auxiliaries whose patriotism has associated them with me in the executive functions During this course of administration and in order to disturb it the artillery of

  • HOW SOME STATES DID NOT LEGALLY RATIFY THE 16TH AMENDMENT
to change it in any way Attorneys who have studied the subject have agreed that Kentucky and Oklahoma should not have been counted as approvals by Philander Knox and moreover if any state could be shown to have violated its own state constitution or laws in its approval process then that state s approval would have to be thrown out That gets us past the presumptive conclusion argument which says that the actions of an executive official cannot be judged by a court and admits that Knox could be wrong If we subtract Kentucky and Oklahoma from the 38 approvals above the count of valid approvals falls to 36 the exact number needed for ratification If any more states can be shown to have had invalid approvals the 16th amendment must be regarded as null and void The state constitution of Tennessee prohibited the state legislature from acting on any proposed amendment to the U S Constitution sent by Congress until after the next election of state legislators The intent of course is to give the proposed amendment a chance to become an issue in the state legislative elections so that the people can have a voice in determining the outcome It also provides a cooling off period to reduce the tendency to approve an idea just because it happens to be the moment s trend You ve probably already guessed that the Tennessee legislature did not hold off on voting for the amendment until after the next election and you d be right they didn t hence they acted upon it illegally before they were authorized to do so They also violated their own state constitution by failing to read the resolution on three different days as prescribed by Article II Section 18 These state constitutional violations make their approval of the amendment null and void Their approval is and was invalid and it brings the number of approving states down to 35 one less than required for ratification Texas and Louisiana violated provisions in their state constitutions prohibiting the legislatures from empowering the federal government with any additional taxing authority Now the number is down to 33 Twelve other states besides Tennessee violated provisions in their constitutions requiring that a bill be read on three different days before voting on it This is not a trivial requirement It allows for a cooling off period it enables members who may be absent one day to be present on another it allows for a better familiarity with and understanding of the measure under consideration since some members may not always read a bill or resolution before voting on it believe it or not States violating this procedure were Mississippi Ohio Arkansas Minnesota New Mexico West Virginia Indiana Nevada North Carolina North Dakota Colorado and Illinois Now the number is reduced to 21 states legally ratifying the amendment When Secretary Knox transmitted the proposed amendment to the states official certified and sealed copies were sent Likewise when state results were returned

  • Tax System: Too Complex To Be Constitutional?
an organization described in section 501 c 4 5 or 6 which would be described in paragraph 2 if it were an organization described in section 501 c 3 The first sentence comes from a 1926 Supreme Court decision that helped establish the right of citizens to known what laws mean The second comes from the tax code To be clear I don t recommend that anyone wage a tax protest by not paying Many have tried and the tax code has a special woodshed to take them to Section 6702 on frivolous tax submissions Penalties jumped from 500 per offense to 5 000 in 2006 The I R S publishes a long list of arguments it warns have already been deemed frivolous Taxes are voluntary you say Good luck United States v Tedder in 1986 made clear that while the general method of collection is voluntary it can be made involuntary in a hurry if you don t volunteer your bit Compliance to tax law you claim is a form of slavery and thus violates the 13th Amendment I admire your creativity But the U S Court of Appeals didn t admire it as much in its 1956 ruling on Porth v Brodrick This is not a nation of law or finance scholars Department of Education studies have shown that nearly two thirds of respondents struggle to make sense of a bus schedule and more than half can t add two items on a lunch menu and calculate a 10 tip If the average person can t fully read or understand the rules the rules no longer seem fair Why don t the courts force tax simplification You d never get that argument in front of a judge says Daniel Pilla a tax litigation consultant and the author of

  • SECRET PLAN FOR EURO INCOME TAX
do not pay more than our share A Conservative Government would defend that position robustly Possible taxes suggested in the report which could be discussed as soon as the start of the European summit in Brussels tomorrow include levies on phone calls flights financial transactions or carbon emissions They would have to raise about 6 4billion a year the net cost of belonging to the EU and equivalent to about 260 for every household in the UK Mats Persson of think tank Open Europe warned the plans would rightly cause concern among British taxpayers Jim McConalogue of the European Foundation which wants to renegotiate European treaties said It is clear from its so called reform agenda that Brussels is committed to the daylight robbery of the British taxpayer Matthew Elliott chief executive of the TaxPayers Alliance branded the idea of direct taxation from Brussels an outrage He added Control of taxation must rest solely in the hands of democratically elected politicians who answer to British taxpayers The EU has shown time and time again it is greedy for power This is another sign they will never stop trying to grab it Ruth Lea of Eurosceptic think tank Global Vision said People need to wake up to the fact we are now in a superstate Year by year we are living in an integrated United States of Europe and this is just part of it The plan dated October 6 would see huge reforms of the EU s 110billion a year budget In his preface Mr Barroso writes that the report presents the Commission s vision for the EU budget reform that should form the basis for further debate with the European Parliament and the Council The current budget deal runs until 2013 The proposals would see big cuts to programmes

  • The Plan to Replace the Dollar With the 'Amero'
be around the three countries of the North American Union not between the three countries We have argued that a likely reason President Bush has not secured our border with Mexico is that the administration is pushing for the establishment of the North American Union The North American Union is envisioned to create a super regional political authority that could override the sovereignty of the United States on immigration policy and trade issues In his June 2005 testimony to the U S Senate Foreign Relations Committee Robert Pastor the Director of the Center for North American Studies at American University stated clearly the view that the North American Union would need a super regional governance board to make sure the United States does not dominate the proposed North American Union once it is formed NAFTA has failed to create a partnership because North American governments have not changed the way they deal with one another Dual bilateralism driven by U S power continue to govern and irritate Adding a third party to bilateral disputes vastly increases the chance that rules not power will resolve problems This trilateral approach should be institutionalized in a new North American Advisory Council Unlike the sprawling and intrusive European Commission the Commission or Council should be lean independent and advisory composed of 15 distinguished individuals 5 from each nation Its principal purpose should be to prepare a North American agenda for leaders to consider at biannual summits and to monitor the implementation of the resulting agreements Pastor was a vice chairman of the CFR task force that produced the report Building a North American Union Pastor also proposed the creation of a Permanent Tribunal on Trade and Investment with the view that a permanent court would permit the accumulation of precedent and lay the groundwork

  • Provinces key to EU trade deal, Quebec Premier says
going to get the deal we want Mr Charest said He described the proposed pact as a groundbreaking initiative on a scale that has never been attempted The accord would go well beyond the scope of the NAFTA agreement between Canada and the United States by encompassing not only trade in goods and services but also the free movement of skilled workers and an open market in government services and procurement Mr Charest said the federal government can sign a treaty with other countries dealing with these areas But he said Ottawa does not have the power to commit the provinces to areas that fall under their jurisdiction It is without effect if we don t sign on he said The fact that provinces will be at the negotiating table reflects their efforts to play a major role in charting the country s destiny on key issues where their interests are at stake The push to remove trade and investment barriers with the EU countries comes as Canada is making an effort to lessen its dependence on the United States its largest trading partner Mr Charest was in Niagara on the Lake yesterday where he and Ontario Premier Dalton McGuinty spoke on a panel at the Ontario Economic Summit about the toll the weakened U S economy has taken on Central Canada Thousands of manufacturing jobs have vanished in Ontario and Quebec in the past few years and the pain is far from over economists say Mr McGuinty told the audience that Canada s premiers will lead their first ever trade mission to China later this fall We need to find more ways to market ourselves as a nation he said Mr Charest has been involved in the initiative involving the EU countries for two years including lobbying business leaders
