    March 2016 Safe Harbour reloaded setting the fox to guard the chickens Thomas Deutschmann CEO of Brainloop talks about the current issues around Safe Harbour and the effect that the new version will have When the European Court of Justice overturned the Safe Harbour agreement in October it caused palpable tension in political and business circles as the EU and USA were then obliged to create a new legal framework for the way they work together Soon after the deadline had passed at the end of January they quickly announced a first draft However anyone hoping for another thunderbolt to follow the one in October making everything better simpler and easier to understand would have ended up very disappointed For the time being all we have is an announcement The final draft is supposed to follow in the next few weeks although the various committees first need to give it their blessing The announcement itself raises questions too and looks like it is actually just a way of playing for time According to the EU Commission the Privacy Shield idea is based on three components The first is the introduction of strict rules for processing EU citizens personal data The second proposes clear rules and transparency governing access to this data by the USA And the third is that EU citizens rights should be better protected with a variety of legal redress mechanisms However it is more than questionable whether these will lead to a significant reduction in the surveillance of EU citizens by the USA The same applies to whether the new agreement will meet the demands of the European Court of Justice It is not clear which interests the US Department of Commerce is really pursuing and who it is supporting EU interests or only those of the
