    the exceptions under which Invacare is permitted to manufacture and sell these devices Notification Guide Verification of Medical Necessity Forms To prevent disruption to patients the FDA will allow Invacare to continue manufacturing and distributing wheelchairs and seating systems with the completion of a Verification of Medical Necessity form This document contains two different forms The first is for replacement devices for when a patient needs to replace his or her current Invacare wheelchair and or seating system or if that wheelchair or seating system has been discontinued or if the patient s needs have changed a substantially similar product The second is for new users when in the professional judgment of a clinician an Invacare wheelchair or seating system is necessary to meet the medical needs of a patient due to a specific aspect of the patient s condition that could not be appropriately met by another manufacturer s device Verification of Medical Necessity Form Replacement Verification of Medical Necessity Form New Consumer Verification of Medical Necessity Interactive Form Replacement New Consumer Service Parts and Warranty Replacement Forms The FDA will allow Invacare to continue manufacturing service parts and replacements for Taylor Street devices To receive components parts raw materials accessories or sub assemblies to service or repair Taylor Street devices please complete the Service Parts form You will need to complete this form only once during the time that Invacare is under the consent decree for all service parts If you need a warranty replacement of a wheelchair or seating system please complete the Warranty Replacement form Service Parts and Warranty Replacement Forms Purchase Orders and Quotes Form The FDA recognizes that some patients for whom providers had ordered or had received a written quote for a Taylor Street device prior to the date of entry of the

    to be Fully Verified A process is fully verified when it can be confirmed by a subsequent inspection or test For a process to be confirmed the verification activities such as the inspection or test and the results must be documented signed and dated by the employee or employees approving the confirmation For product design procedures must be established and verified for each device s specific design Design verification must confirm that the final design of the device meets its previously defined design requirements The results of design verification including identification of the design and method s must be documented signed and dated by the employee s approving the verification What does it mean for a test to be Adequately Validated Validated processes are shown by objective evidence to consistently produce a result or product that meets its pre determined specifications Validation must be performed by properly trained employees and the monitoring control methods and data must be documented signed and dated by the employee s performing the process When changes or process deviations occur the manufacturer must review and evaluate the process and perform revalidation where appropriate These activities also must be documented What does it mean for a design to be Adequately Validated Validated designs are shown by objective evidence that the device specifications conform with the pre defined user needs and the device s intended use Validation must be performed by properly trained employees and the monitoring control methods and data must be documented signed and dated by the employee or employees performing the process When design changes occur the manufacturer must review and evaluate the design change and perform revalidation where appropriate These activities also must be documented What does it mean for a procedure to be Adequately Established Established means defining documenting and implementing a specific activity or process For a procedure to be adequately established the manufacturer must have a procedure in place that has been defined and documented and that procedure must be implemented and followed consistently Any deviations from the procedure also must be documented What does it mean to have a Repeat Observation A repeat observation occurs when on two successive investigations FDA investigators observe continuing problems with the same quality system s Invacare received repeat observations at the corporate and Taylor Street facilities Although we were addressing the issues identified by the FDA we did not adequately resolve the Agency s concerns To rectify this we are improving our quality and regulatory system to one led by managers with medical device and FDA experience We have invested significantly in quality systems this year and hired a new Senior Vice President of Quality Assurance and Regulatory Affairs in December of 2011 What are Non Conforming Products A nonconforming product is one that did not meet at least one of the specified requirements regarding components manufacturing materials in process devices finished devices or returned devices What does it mean to have non conforming products that are not Adequately Controlled Each product must

    to enter into a consent decree The FDA regulates all aspects of medical device companies from when we design and engineer new devices through manufacturing and distribution Invacare has always had quality control systems and processes in place however the FDA made inspectional observations at Invacare s Taylor Street and corporate facilities in Elyria Ohio regarding areas we needed to improve to bring them into compliance with the Quality System Regulation We ve been working on those improvements for more than a year and we will continue to work every day until the FDA notifies Invacare that the facilities are compliant How long will normal operations be suspended There are specific steps that Invacare has to take to resume operations at its Taylor Street manufacturing facility Link to press Release However we cannot speculate as to how long it will take to complete the audits and resume full operations We re committed to full compliance with FDA regulations and we intend to work cooperatively with the FDA to resolve their concerns as quickly as possible All other Invacare manufacturing operations remain in full production Has the FDA raised specific quality or safety concerns in its observations No The FDA did not raise a specific product safety concern in the consent decree Invacare has a 30 year history of making life s experiences possible for the people who rely on our products We ve always taken patient safety and product quality very seriously We rigorously test our products to ensure their quality and safety and we stand behind every product we make when they are used as directed Did the FDA require Invacare to perform product recalls No What products will be impacted The limitations on manufacturing only apply to the power and manual wheelchairs wheelchair components and wheelchair sub assemblies
