    the lease Statement from Hoey Denning Solicitors on behalf of Flanagan Securities Limited On behalf of Flanagan Securities Limited we wish to clarify some of the issues surrounding the closure of the Menarys store in Tullamore which was announced on 2nd February Menarys store occupies a major trading position in the centre of Tullamore town In 2008 an expenditure on refurbishment by the then owners of 1 million on this building was a major vote of confidence in the town centre at a time when the downturn was already well established Notwithstanding a substantial rent free period the rent payable by Menarys was in very substantial arrears of rent by 2012 and this resulted in litigation by the then owners The matter was resolved by an agreement for the payment of the rent arrears over two years and a substantial reduction in rent A second rent concession came in June 2014 when Menarys entered a creditor s voluntary arrangement CVA in Northern Ireland which is similar to the examinership process in this jurisdiction This reduction in rent was reluctantly agreed to such that the revised rent was now only 40 of what it had been That arrangement was for two years only and allowed for a break in the lease in early 2015 When the break was exercised Menarys had reported significant financial losses over the previous three years up to January 2015 Given the outlook the decision was taken by the landlord to act on the agreed break in the lease and start looking for a more secure long term partner who could bring sustainable jobs to this valuable town centre location Flanagan Securities Limited and associated companies in the Flanagan Group have worked for over fifty years in providing both directly and indirectly job opportunities in Tullamore Flanagan

    to do so if Ms McNamee had not delayed in pursuing the civil action it was claimed The High Court in rulings by two different judges found that any prejudice to him could be overcome by allowing a transcript of what Mrs Boyce said in the criminal trial to be admitted as evidence in the civil case The High Court also ruled that certain allegations after 1985 were statute barred A three judge Court of Appeal yesterday unanimously found the High Court erred in not dismissing the proceedings Ms Justice Mary Irvine said it was a tragic claim and it was an enormous sanction to dismiss a claim of such a nature on grounds of delay However there are clear principles which must be applied so as to ensure the effective administration of justice and basic fairness of procedures she said Proceedings must be conducted within a time frame such that a defendant will not be unduly prejudiced by inordinate or inexcusable delay The judge was satisfied the delay by Ms McNamee in pursuing her claim exposed the defendant to a significant risk of prejudice in terms of his ability to defend the very serious allegations against him That stemmed principally from the death of his wife in 2005 and had there not been the delay it is likely the civil action would have been heard when Mrs Boyce was alive Earlier Ms Justice Irvine said a transcript of evidence is not the same as evidence from the witness box A transcript is arid devoid of character and a poor means of imparting sincerity or sensitivity Mrs Boyce may have been a truly impressive witness and a transcript was no substitute for her direct verbal testimony Credibility was a major issue in the criminal proceedings in which Ms McNamee told
