the one running the business wherever you are located is your nexus your base of operations and that will obligate you to follow local laws for tax even if you re abroad If am not sure you are able to state But it doesn t sound like that s the case you re selling in Africa which means you re subject to both customs and whatever tax laws are in place in the countries where you sell That said since you re in New York you should register your business there you technically have a nexus there since it s where you live and operation to get your sales tax exemption If you re stuck or unsure of what to do I recommend talking to either an authority on experts or an accountant attorney versed in this kind of tax law That s really the best way to make sure you re in compliance and doing everything have a base of operations you don t have to collect sales tax at all Since you re dropshipping you most likely won t have to deal with the nexus issue for your suppliers Delaware will be your only nexus However some suppliers will require you to show proof that you re a registered business that s your EIN I don t know if you ll have to have a physical address listed I suggest you check with an business has nexus in their home state and in states where they establish a considerable presence nexus in many cases purely by using a warehouse or fulfillment service for their stock to sell to that state s residents I understand that the same concept is supposed to apply to the use of Amazon FBA services whereby the FBA seller is required to collect and remit sales tax to any state where Amazon ships the business goods out from However with this in particular I wonder how any FBA seller would even know in advance prior to the customer adding to cart and checking out and prior to actual fulfillment by Amazon out of which Amazon FC the order will be shipped from so how could this even be set up in the Amazon settings so that the appropriate tax rate for the respective state would be charged prior to checkout I understand furthermore that you responded to the previous post to Dev 27 Aug that you think drop shipping would not create nexus for the seller the drop shipper s business parter Are you sure about that I have read conflicting information about this However I think it would be ridiculous to deem a drop shipper s warehouse location as nexus for the seller in a different state The seller is not really operating the warehouse it s not their goods even though they buy goods on an individual basis to be directly shipped to their customers out of the drop shipper s warehouse It s only slightly different to an affiliate relationship where the affiliate would send sales leads to the wholesaler who then pays a commission and in turn sends out the same goods out of that warehouse Still I wonder if using a drop shipper for THEIR goods in such a business relationship definitely does not create a sales tax nexus for the seller in another state And most importantly being a non US based resident living in Australia do any of the above three mentioned scenarios apply to me anyway In other words would international eCom store or FBA merchants operating in the US even have to register for sales tax in any of these scenarios or are they in fact exempt Would it be better for me to set up an LLC in the US At the moment I am contemplating various business ventures If you re not in the U S you don t need to worry about paying sales tax in the U S Period You ll have to worry about registering in Australia The good news is that many U S suppliers will still gladly work with you Some wholesale suppliers might request proof of your registration in Australia so be prepared If you have a warehouse in the states or you use FBA that becomes a nexus However 2 states where Amazon has FBA centers don t collect sales tax which means in those states it s a moot point Importing is where things get very tricky because you start having to employ agents on your behalf Defective DEFECT POLICY went into effect I spent about 40 hours auditing 900 transactions and discovered many of Ebay s flaws For example if you are not using one of the top Four USPS UPS FEDEX or DHL ebay does not capture tracing information from any other carriers and your shipping times will be defective They will accept OTHER carriers where you update the tracking but they don t capture the data so it will count against you even if the person received the item on time is happy and left you positive feedback Unbelievable As well I discovered that they would not correct any of their own errors after I was promised that they would remove the defect and countless hours on the phone with Ebay Customer Service if their error was over 120 days even though they are RETROACTIVELY counting defects the entire year prior to the August 20 12014 live date that is if you had under 100 transaction per month for the prior 3 months With the loss of the Top Rated position in September 2014 right before our busiest selling season as you other sellers know I am now in the position of digging myself out of retroactive defects that were considered defects a year ago What a mess Regarding Bonanza I have tried to purchase from them a couple of times and the orders are always cancelled because the sellers don t have the items in stock It reassuring that while I am selling less I ve decided to reading your invoice for January which turned up no problem We ve held a relatively short term account but we had accumulated great feedback until the rug was pulled from under our feet with no explanation other than below average seller status after being advised to open an eBay shop After a brief chat with eBay reason is that orders have been cancelled My explanation in writing was being as we are manufacturers of our items we had a pre Christmas mechanical breakdown and not wanting to let anyone down we cancelled the orders nine along with messages to explain why everyone responded and understood our dilemma along with a high percentage stating if we got back to business then carry on with the transaction Unfortunately we could see a way through so reimbursed all via paypal with charges incurred no cases where opened or no bad feedback was left on our account I must add that all orders where sent and in time for the festive season and free of charge which must have boosted rules are rules so nothing could be changed which was disappointing to say the least but the disappointment only lasted one week before they trashed all our hard work and the account Anyway at least I know now from reading the above messages that it s hardly worth sitting here waiting for good news as I don t think it s worth the hassle being with ebay anyway If they can t see what the problem is with their selling site then I m not stepping forward to tell them Yes it is the No1 selling site but with what we all know in business if you run something like that it should by rights fail I feel about 15 each Although I don t have a higher quantity of listings than I did 4 months ago my monthly bill has now increased 300 I used to pay 300 per month now I pay between 800 and 900 It s ridiculous Because of the items I sell I am now working all month just to pay the outrageous fees So Today I started moving my listings over to rbiz It s free to list and they charge a small final started selling in 1 day I sold over 1000 and then they froze my account Told me they had to make sure everything was good with fraud protection and that the hold would be released within 24 hours and i could get back to selling Shortly after that they suspended my account and said i was not aloud to sell vaping supplies although there are still 100 s of people selling them on their site and have been for years Now they are holding my money for 90 days and have closed my account But yet 100 s of others are still selling the same items as we were selling seems they can do what ever they want and think they can get away with it have spoken with class action attorneys and they are looking into the possibilities of a major payday how does this sound to you So I recommend that everyone just re giving you their money they expect 5 star service even if they re buying something that s less than 2 It may sound crazy but it s true This is why I haven t gone live with my online store yet because I already know what s going to go wrong So I ve been buying from my suppliers to make sure that they re going to ship fast and leave my customers happy It s seriously such a pain and after ordering from them it makes me nervous I don t have a reputation or a credit line but the warehouses I would ideally partner with would 1 have a warehouse in the U S 2 ship with USPS which in my opinion has the cheapest and most reliable shipping service and 3 have quality product at cheap prices It s so hard for because I feel like I m so alone on this and I wish the best drop shippers would
