    operating system we do not claim responsibility for our customer s servers Keeping the security of a server up to date is a continuing task and is the responsibility of the customer While our builds provide the initial security to keep your company secure new security problems arise with all server types every day and we cannot maintain the security of all of the systems operated by our customers The only exception to this case is servers that are directly maintained by our company such as the servers that host Cobalt Web Sites and also the iBizPanel to which the customer does not have shell access Solasus will maintain the security on these systems In the event of a system compromise on a host we are not maintaining it is the responsibility of the customer to back up his data and contact us to take action Our policy is to immediately re install any compromised servers on our network as they pose a threat to all of our systems We can perform a re install for a 50 consulting fee The typical downtime during one of these re installs is about ten minutes IRC activity We discourage IRC activity on the Solasus network because it attracts network attacks far more than any other activity If your server is attacked or is used to attack other hosts and is found to be running IRC Solasus may disconnect your IRC server and require you to supply a 500 security deposit to cover costs associated with future network attacks At the end of your term of service with Solasus or if you discontinue IRC activity we will refund the deposit if there have been no network attack incidents Contact us for details on how to make this payment Policies Conditions Acceptable Use Privacy

    Customers of Solasus resellers 2nd level accounts will have due dates based on the date in which they first purchased services from a Solasus reseller if the Solasus reseller has enabled prorates on their product offers All subsequent purchases regardless of purchase date are pro rated to match the original purchase date with the exception of Overages Bandwidth Database and Domain Renewals Pro ration occurs on the 2nd month s bill Billing Reminders are sent to the Billing Contact listed in your online account manager A Billing Reminder sent 1 day before the due date Accounts which are set up for Auto Payment will have monthly total charged 5 days before the account due date The 5 day window is provided to correct any errors which arise from expired credit cards etc Confirmation and failure notices for auto payments are sent to the billing contact for notification purposes Solasus accounts are automatically polled at 12 00pm PST the day following the due date at which time unpaid services are automatically suspended Additional Billing Information In order to add new services to your Solasus account each customer must carry a balance large enough to purchase the needed service or must pay at the time of purchase All services are pre paid Auto Payment using credit card or bank check is the most efficient method of payment Should an auto payment decline Solasus will attempt to re charge the card on file every day thereafter until it either succeeds or another credit card is specified Customers will receive notification each time an attempt is made Dedicated Servers which are overdue for more than 10 days will be deleted and the data will no longer be accessible to the customer Dedicated Servers or Websites with unresolved Abuse or AUP matters which are not

    done on average usage and not on peak usage Should you exceed your included bandwidth we will only bill you for the amount you go over You are responsible for ALL bandwidth to and from your server which is measured from the switch port your server is connected to If you control multiple servers and do not want to be billed for traffic between them please consider purchasing a server cluster which will allow for more flexible bandwidth options We take snapshots of the data rate of each server s switch port every 5 minutes These snapshots are added together for a period of 30 days The total bandwidth used is divided by the number of snapshots taken to determine the average or billable bandwidth usage An overage is when the billable bandwidth usage exceeds the amount of bandwidth available in the server s monthly plan Overages are measured in tiers of 1 Mbps 324 GB and cost 60 per tier If your plan is for 4 Mbps and your average usage from the past 30 days is measured at 5 36 Mbps your account will be charged for two overage tiers at 60 each Each additional tier is good for 30 days so you will not be billed further if your usage remains within that tier However if your average usage at the end of the 30 days is still at that level and has not dropped you will be billed for the tier again That tier will be good for another 30 days Overages are due on your next statement date If the overage occurs within 10 days of the end of the current statement it will not be due until the end of the next statement This way you always have at least 10 days to pay
