letter until after the incident Q Are you saying it s not credible Q Now what did you think that it was going to the troops in Saudi Arabia MCCURRY It is issued by a group called the Movement of Islamic the Jihad wing which is a group that we ve got some familiarity with They operate in Saudi Arabia Most of the text of the letter is referencing events in Saudi Arabia Q Are you saying that this is not a credible that even after looking at it you do not think this is a credible piece of evidence MCCURRY They re going to analyze further the importance of this letter that there s nothing in our preliminary analysis that would have led us to link this particular letter to the TWA incident Q But Mike in terms of you said there are three categories hoaxes harassment and things we take seriously Whether or not this would have been linked to this event if you had gotten it earlier is this a hoax or harassment or do you take it seriously MCCURRY I can t describe it as any of those three categories It would be analyzed further The important thing is our experts don t believe this sheds much light on the TWA incident which is the most Q You don t think it s warning about something that s going to happen in Saudi Arabia MCCURRY It is similar to warnings that appear almost daily in the region and that you can also read on the Internet And they have been on the Internet almost daily Q What can you tell us about the reports that we re hearing that the Pentagon is now analyzing what the FAA believed to be a blip on the radar screen MCCURRY I don t want to say much The National Transportation Safety Board will tell you more about the status of their investigation I will leave it to them What they normally do not that there is anything normal about a crash investigation but they analyze radar signatures for anything in the air in and around the time that an incident occurs And they ve been doing that and they ve been trying to clarify any abnormalities that they see in their radar data They re still working on that That s the best I can tell you Q Is there some concern As you well know there s been some speculation by some American officials that this could have been some kind of surface to air missile MCCURRY There is no American official with half a brain that ought to be speculating on anything of that nature There s no concrete information that would lead any of us in the United States government to draw that kind of conclusion They have to look at a lot of different possibilities They continue to assess many different possibilities They continue to look at all the information that would be relevant to getting answers But we are quite some time away from having any answers that would point us in a particular direction Broadly stated they ve got a lot of different possibilities that they continue to examine and they have not narrowed to my knowledge the focus on any particular explanation for this incident Q Did they detect any abnormality on the radar screen that you re aware of MCCURRY They are looking at they are analyzing the radar tracks and making sure they understand everything on it and that work continues Q Mike does the President s statement of earlier in the day that there s no evidence to suggest terrorism still stand MCCURRY That s correct because there s no there s nothing that suggests one particular explanation over another one that I m aware of at this point Q to suggest that it was an accident either Q Has the President talked about his trip tomorrow and how he about going to the Olympics and the tone he wants to set in terms of all the worry that was already in place down there about security MCCURRY Well the Olympics are an event that draws the world together and unfortunately so is a moment of tragedy like this one The President tomorrow was going to celebrate a moment in which the world comes together in the name of friendly competition but it s a moment that will be made somewhat sadder by the tragedy that s now been suffered But in its own way events of this magnitude draw nations together for common purposes And that s ultimately the spirit that the President intended to celebrate tomorrow Q What did the President tell Mr Dole and the congressional leaders MCCURRY He gave them much the same briefing that has been available from those responsible for briefing in our government the National Transportation Safety Board and the Coast Guard He shared with them the information that s available I ll contradict some who have suggested that he suggested to any of these folks that he talked to one particular theory over another The President was very careful to do that and very specifically told me that he had not suggested any particular hypothesis or theory in his telephone calls Q Like that it was an explosive device or this or that or anything in particular MCCURRY That s correct Q Mike has he spoken to any foreign leaders Has he spoken to the President of France MCCURRY He s David jump in if there s any additional he had about a five minute phone call a short while ago with Prime Minister Netanyahu of Israel The Prime Minister had     doing and we ll continue to be concerned about this Q Is there any consideration to recommending dependents leave or anything of that kind MR BURNS Nothing to announce at this point Judd Q Nick have you all further evaluated the letter or statement which you received yesterday which would seem to further threaten U S people MR BURNS Yes we ve looked very carefully at a it s not a letter just to be precise It is what I would describe as a political tract It s from a group called The Movement of Islamic Change the Jihad wing in the Arabian peninsula It s a political manifesto that was delivered apparently on July 16 to the Al Hayat newspaper chain in London The London offices of the Al Hayat newspaper The United States Government obtained this political tract yesterday morning July 18 at around 10 30 in the morning We were given this letter this tract it s not a letter by a major American news organization We gave the letter immediately to the FBI and to other agencies of the U S Government It was a copy of a typed Arabic script letter We had it translated here in the Department by our professional Arabic linguists native speakers of Arabic professional translators and I ve got the letter the tract in front of me I shouldn t say letter I can tell you it is a general fulmination against the American military presence in Saudi Arabia and against the Saudi Government At the end of the letter it talks about the prospect of an attack on the United States forces we believe in Saudi Arabia This seems to be a very general threat against our forces in Saudi Arabia I know there s been some talk about the specific language at the end of this tract whether or not it refers to some kind of imminent threat We do not believe it does The Arabic word for tomorrow is bukra The word used here is the Arabic word for dawn which is a very different word It has very general meaning about the future and we don t believe that this particular tract at this point there s nothing in it that would lead us to believe it s connected with the tragic incident concerning TWA Flight 800 Q Are you aware of any other such statements as this out there that threaten U S citizens or military and diplomatic people either in Saudi Arabia or anywhere else in the Middle East that could possibly be linked to TWA MR BURNS I am not aware of any specific threat before it happened before the accident occurred against TWA Flight 800 I am not aware of it We are aware of this piece of paper which we don t believe bears any reference to the tragedy of the TWA flight We have had specific threats against our installations in Saudi Arabia and we ve talked about that publicly We issued a public statement on that last week But I m not aware that the United States Government received any threats against TWA against the air route New York to Paris before the accident occurred I am not aware of any subsequent threats since July 17 the last two days I m not aware Now other agencies of the U S Government may have received warnings that we re not aware of I doubt it but I m not aware of it Really on this you know I think your ultimate authority will continue to be the NTSB and the FBI Q Are you ruling out any possible involvement in the TWA bombing by this group MR BURNS What we are doing Sid is very clear The FBI s I think underlying public message is We re not ruling anything in We re not ruling anything out You can never speak with 100 percent certainty in these matters and we certainly don t presume to be doing so But we ve been asked by all of you to give you our best assessment of this political tract and our best assessment is this is a threat against the United States and the Saudi Government but the United States in Saudi Arabia It is consistent with the many threats that we have received from organizations like this and from this particular organization about our presence in the Middle East not about civilian air traffic elsewhere in the world such as here in the United States Q You report that there was a worsening situation in terms of number of threats in Saudi Arabia Could you please give us an idea how many threats are issued a day and are they all from the same organization or from this organization MR BURNS I m not going to be specific but I will refer you to the public announcement made by the State Department last week about the very great concern we have for Americans in Saudi Arabia We wanted all Americans who live in Saudi Arabia to be aware that we think the security situation is of concern that they should take all appropriate measures to protect themselves that the private Americans they ll have to make their own decisions about whether they want to be there but we ll give them all assistance that we can give them and I m thinking of the corporations now Mobil and ARAMCO and others to help them It s our obligation in situations like this to be as open as we can with the American public about things that we understand diplomatically and through other means Q I understand that other European countries received threats in Saudi Arabia Are you coordinating with our allies in Europe about these threats MR     fistedly cites the 1988 VINCENNES Airbus incident and attempts to link TWA to an Aegis missile fired from an unnamed VINCENNES class cruiser There is no such thing as an Aegis missile and the nearest Aegis type cruiser the USS NORMANDY was 213 nm 395km to the south off the coast of Virginia The range of the SM 2MR Standard SAM the only SAM clarification added 3 5 00 R Lewis missile fired from all Aegis type cruisers and destroyers in the US Navy is only 40nm 73 km If one had been launched the bright flash and heavy plume of smoke would have been seen for miles around and could not be missed by other aircraft flying in the area It simply did not happen But Iran says a missile was fired WHAT DID HAPPEN TWA Flight 800 was a Boeing 747 131 N93119 the 153rd Built in 1971 it was originally ordered by Eastern Airlines but ironically was scheduled to be sold to the Imperial Iranian Air Force but was never delivered The 747 is an extremely rugged design originally designated the CX 4 when it competed against Lockheed s CX 5 C 5A Galaxy for the CX HLS Cargo Experimental Heavy Logistics System program N93119 had logged 16 869 cycles takeoffs landings and 93 303 flying hours It was nearing the end of its service life It had a history of corrosion and stress cracking near the joint of the forward fuselage center wing box joint where it separated in flight and fuel leaks All of these problems had been corrected and it met all airworthiness directives None of these problems has been connected to the fatal crash On July 16 the day before it crashed one of its crew members reported that it handled flawlessly with no quirks noted Flight 800 was originally scheduled to depart JFK at 7 00 PM 2300 GMT bound for Paris France but was held up by replacement of a faulty engine pressure gauge the breakdown of a baggage conveyor vehicle and the need to remove a piece of unaccompanied luggage That luggage was reloaded when its owner later arrived The aircraft took off from JFK at 8 19 PM 0019 GMT At 8 30 19 PM the crew made its final transmission to air traffic control acknowledging clearance to climb to 15 000 ft 4 572m It never made it Eleven seconds later at 8 30 30 PM all four channels of the cockpit voice recorder detected a split second trace of a loud and still unidentified noise then fell silent That mystery sound is said to be different from any other recorded in past crashes By 8 31 10 PM TWA Flight 800 was gone from the radar The day after the crash radar tapes were said to have detected an unknown object travelling toward the aircraft at a high rate of speed Upon review of the tapes in Washington that blip was now judged to be a radar anomaly or a glitch Imagery from infra red imaging Defense Support Program DSP satellites were screened for evidence of a missile launch but the rotation of the satellites is such that a small supersonic missile could easily strike a target before the next sweep of the sensor Besides they are only designed to pick up the plume of a large missile or the afterburner of a jet engine They did detect the fireball of Flight 800 but no missile That supposedly ruled out a missile It should not have The sky at 8 31 PM on a July evening is a dusky grey It would be bright enough to highlight the profile of a 747 while leaving the waters of the western Atlantic dark enough to hide the launch of a small missile with a very faint smoke trail The FBI interviewed thousands of people on Long Island aboard other aircraft at the time and aircrews of the HC 130 transport and an HH 60G helicopter of the New York Air National Guard s ANG s 106th Rescue Wing operating in the area as part of a night rescue exercise Several conspiracy theorists and Iranian disinformation artists have claimed that one of these aircraft fired a missile at Flight 800 but neither is equipped with any missiles and their only weapons are small pintle mounted machine guns on the HH 60G Pave Hawk helicopters Interestingly the FBI was focusing its investigation on boats some 40 ft 12m in length that had either been chartered or reported as stolen A boat of that size would provide a very stable platform for someone aiming a laser sight for a SAM launcher even if the waters had not been dead calm and the winds light at only 4 kts The FBI searched all boats returning to the marinas on Long Island for what was described by one reporter as bomb residue In fact they were likely looking for residue from the booster motor of a SAM Several eyewitnesses on and off the water reported seeing streaks note the plural of light going up toward and intersecting with TWA 800 just before the first explosion However there was no description of an external explosion as though a proximity fuze had detonated There was a brief flash of white light followed by a large flash of orange flame Two massive fireballs erupted some 24 seconds according to investigators after the separation of the forward fuselage The main section of the aircraft traveled another 2 1 2 miles 4 km before it too plunged into the ocean WAS IT A BOMB OR A MECHANICAL FAILURE The leading theory had been that the aircraft was downed by a bomb But there has been very little trace of any explosive residue Investigators found traces of PETN and RDX both components of the plastic explosive Semtex used in many past bombings including Pan Am 103 Investigators thought this might be a repeat of that bombing but there was no

    track the activities of foreign terrorist organizations maintaining a presence in the United States There are obvious operational considerations that limit what we can discuss in an open forum about the presence of terrorist groups in the United States I can tell you that the FBI has identified a significant and growing organizational presence here Palestinian Hamas Iranian backed Hizballah and Egyptian based al Gama at al Islamiyya each has established an active presence in the United States The activities of the American wings of these organizations generally revolve around fund raising and low level intelligence gathering In addition there are still significant numbers of Iranian students attending U S universities and technical institutions In 1997 419 student visas were issued to new and returning Iranian students A significant number of these individuals are hardcore members of the pro Iranian student organization known as the Anjoman Islamie which is comprised almost exclusively of fanatical anti American Iranian Shiite Muslims The Iranian government relies heavily on these students studying in the United States for low level intelligence and technical expertise However the Anjoman Islamie also provides a significant resource base which allows the government of Iran to maintain the capability to mount operations against the United States if it so decided Response to Terrorism In the face of these potential threats the U S government has significantly enhanced its response to international terrorism in the five years since the World Trade Center bombing There are five traditional offensive ways through which the government fights terrorism diplomacy sanctions covert operations military options and law enforcement action Some of the measures in place span more than one of these areas For example the Antiterrorism and Effective Death Penalty Act AEDPA of 1996 includes both diplomatic and law enforcement provisions Enactment of the AEDPA has enhanced the ability of the U S government to respond to terrorist threats As I mentioned this act includes a wide range of counterterrorism provisions For example section 302 of the Act authorizes the Secretary of State in conjunction with the Attorney General and Secretary of the Treasury to designate as foreign terrorist organizations FTOS groups that meet certain specified criteria This designation means that funds raised in the United States by FTOS can be blocked by U S financial institutions The Act provides law enforcement with a potentially powerful tool Among other things it gives us a means to disrupt the ability of terrorist organizations to fund their destructive activities However it would be overly optimistic to consider this act a panacea to the problem of international terrorism Financial investigations are by their nature personnel intensive and time consuming Investigations into the financial operations of clandestine organizations on the shadowy fringes of transnational politics can be particularly complex It will take time for the AEDPA to have significant impact on the 30 groups designated as foreign terrorist organizations I encourage the Congress to give the AEDPA time to work As with many measures of this type its most powerful impact may stem from its deterrent effect As investigators build successful cases and prosecutors develop sound prosecutorial strategies to enforce the provisions of the AEDPA targeted groups may decide that fund raising activities in the United States are not worth the risks As you are aware recent congressional appropriations have helped strengthen and expand the FBI s counterterrorism capabilities To enhance its mission the FBI centralized many specialized operational and analytical functions in the Domestic Counterterrorism Center Established in 1996 the FBI Counterterrorism Center combats terrorism on three fronts international terrorism operations both within the United States and in support of extraterritorial investigations domestic terrorism operations and countermeasures relating to both international and domestic terrorism The FBI Counterterrorism Center represents a new direction in the FBI s response to terrorism Eighteen federal agencies maintain a regular presence in the center and participate in its daily operations These agencies include the Central Intelligence Agency the Defense Intelligence Agency and the United States Secret Service among others This multiagency arrangement provides an unprecedented opportunity for information sharing and real time intelligence analysis This sense of cooperation also has led to other important changes During the past several years the FBI and CIA have developed a closer working relationship This has strengthened the ability of each agency to respond to terrorist threats and has improved the ability of the U S government to respond to terrorist attacks that do occur Because warning is critical to the prevention of terrorist acts the FBI also is in the process of expanding the terrorist threat warning system first implemented in 1989 The system reaches all aspects of the law enforcement and intelligence communities Currently more than 35 federal agencies involved in the U S government s counterterrorism effort receive information via secure teletype through this system The messages also are transmitted to all 56 FBI field offices and 33 foreign liaison posts If threat information requires nationwide unclassified dissemination to all federal state and local law enforcement agencies the FBI transmits messages via the National Law Enforcement Telecommunications System In addition the terrorist threat warning system allows for the dissemination of unclassified terrorism warnings to the U S corporate community as well as the public at large via the Internet press releases and press conferences The FBI s counterterrorism capabilities also have been enhanced by the expansion of our Legal Attache or Legat offices around the world These small offices can have a significant impact on the FBI s ability to track terrorist threats and bring investigative resources to bear on cases where quick response is critical As I ve mentioned the FBI currently has 33 Legat offices Many of these have opened within the past 5 years in areas of the world where identifiable threats to our national interests exist We cannot escape the disquieting reality as evidenced by the World Trade Center bombing that in the late 20th century crime and terrorism are carried out on an international     are desperately seeking to frustrate a U S Iranian dialogue which they perceive as a threat to their own power Numerous Iranian defectors including a former top ranking intelligence operative known as Abolghassan Mesbahi have provided Western intelligence services with detailed and strikingly similar accounts of how Iran uses non Iranians to carry out terrorist operations around the world Just two weeks before the twin embassy blasts 22 year old defector Ahmad Rezai the son of former Revolutionary Guards commander Maj Gen Mohsen Rezai told me that Mr Khamenei and former President Hashemi Rafsanjani had personally ordered terrorist attacks One of the Iranian regime s goals repeated publicly by officials at every opportunity is to drive the U S from the Persian Gulf According to Mr Rezai it was for this reason that hard liners ordered the bombing of the Khobar Towers building in Dharan Saudi Arabia in 1996 that killed 19 U S servicemen Mr Rezai says that his father who is still in Iran and who told his son he fears for his life provided him details of the bombing in the hope he would tell the story once he escaped In the Dhahran bombing Mr Rezai alleges the Iranian regime turned to Saudi and other Arab dissidents including networks run by former Saudi financier Osama bin Laden Mr bin Laden has a long history of anti U S attacks Trained in the 1980s as an anti Soviet fighter in Afghanistan Mr bin Laden soon turned against the Saudi government and against its primary backer the U S once American troops were stationed on Saudi soil to defend the kingdom against Saddam in 1991 An international investigation I conducted for Reader s Digest published in July uncovered evidence not only of Mr bin Laden s involvement in the Dhahran bombing but of at least eight attempts against U S and Saudi targets since then that were foiled by Saudi intelligence operatives Mr bin Laden has denied direct involvement in the Dhahran bombing while applauding those who did it My investigation also uncovered convincing evidence that Mr bin Laden financed the World Trade Center bombing in 1993 training master bomber Ramzi Yousef and sending him on what he hoped would be a world wide terror spree from New York to Manila and finally to Pakistan This past February Mr bin Laden issued a religious order or fatwa telling his followers to carry out attacks against American civilians and military personnel wherever they could around the world Mr bin Laden commands a far flung network of former Afghan fighters who have been involved in terrorist attacks and liberation struggles from Algeria to the Philippines According to Ahmad Rezai the Iranian government transmits orders and explosives to the bin Laden networks through high level intelligence emissaries it dispatches to Syria No orders are transmitted by telephone for fear of U S communications intercepts Saudi dissidents close to Mr bin Laden told me that members of his networks were involved in the

    commanders The FBI had already declared the TWA loss a non criminal event illegally quashed the testimony of TWA witnesses and illegally sealed indefinitely real evidence and laboratory testing At enormous expense the NTSB political leadership had convinced a technically inept media that its nonsense mechanical failure theory was plausible In early December 1997 three problems remained 1 disgruntled inside investigators who might go public during the Baltimore Hearings like Captain Stacey 2 investigative journalist James Sanders who was talking to an interested producer Oliver Stone and 3 James Traficant the sole Congressman looking into the Federal investigation who s questions were embarrassing the NTSB and FBI The Justice Department solved all three problems by taking direct action against those individuals between 5 and 12 December 1997 MALICIOUS PROSECUTION The Sanders conviction should be vacated and all felony stigma expunged because they were victims of a malicious prosecution undertaken to facilitate a political cover up Your Honor the Constitution provides you immunity from political pressure through life tenure on the Federal bench In cases like this you are the people s lifeline a constitutional check and balance with the power to stop in its tracks politically motivated assaults on private citizens In the TWA investigation the government has clearly acted as a partisan and proactive interested party silencing witnesses distorting facts and striking down its critics by all means available Please restore the Sanders full citizenship rights and rebalance the scales of justice IMPROPER PROSECUTION UNDER TITLE 18 The Sanders conviction should be vacated because they were prosecuted outside the intent of Title 18 The statute is designed to protect aircraft crash debris from loss to souvenir hunters scavengers or other parties whose pilfering would prevent qualified aircrash investigators from physical examination and laboratory analysis of real evidence In this case the only scavengers or pilferers who were preventing qualified aircrash investigators from examination and laboratory analysis of real evidence were FBI agents acting without due regard for the controlling Federal Statute Title 49 of the US Code Testimony at Senator Grassley s hearing clearly proved that FBI agents were guilty of far more serious violations in removing evidence without authorization evidence that remains missing to this day Non response of the FBI to NTSB Party Investigators was a constant impediment to progress The FBI has no professional crash investigators Captain Stacey s transfer to James Sanders of a small sample of suspicious material for laboratory testing may have been overzealous outside of normal protocol and actionable under Title 49 by sanctions such as being severed from the investigation Prosecution under Title 18 for either man however is totally inappropriate because their actions were taken within the broad scope of a Title 49 aircrash investigator s mission which is to develop evidence and to expeditiously discover the cause of an air disaster SUBVERSION OF TITLE 49 The Sanders conviction should be vacated in order to restore Title 49 to the status intended by Congress Allowing the Sander s and Stacey
