  • Wet Wipe Manufacturer Agrees To Substantiate Flushability Advertising Claims Under Settlement With FTC
    not claim that its moist toilet tissue is safe for sewer and septic tanks unless it has substantiation for those claims In addition Nice Pak will stop providing trade customers such as retailers with information to make such unsubstantiated claims Costco CVS Target and BJ s Wholesale Club were Nice Pak customers that sold the formulation of the company s moist toilet tissue that was the subject of the complaint under their own private labels The evidence didn t back up Nice Pak s claims that their wipes were safe to flush said Jessica Rich Director of the FTC s Bureau of Consumer Protection If you claim a product is flushable it needs to flush in the real world without clogging household plumbing or sewer and septic systems According to the FTC s complaint Nice Pak violated the FTC Act by misrepresenting that a certain formulation of its wipes 1 are safe for sewer systems 2 are safe for septic systems 3 break apart shortly after being flushed and 4 are safe to flush The FTC also alleges Nice Pak provided the means and instrumentalities for retailers and others that marketed the product under their own label to make similar misrepresentations The company s tests did not reflect real world household plumbing or septic conditions the FTC alleged The proposed administrative consent order settling the FTC charges prohibits Nice Pak from misrepresenting that any wipe is safe to flush unless it can substantiate that the wipe will disperse in a sufficiently short amount of time after flushing to prevent clogging and or damage to household plumbing sewage lines septic systems and other standard wastewater treatment equipment The test must also replicate the physical conditions of the environment where the wipes will be disposed In addition the proposed order prohibits Nice Pak from making representations about the benefits performance or efficacy of moist toilet tissue unless the statements are not misleading and the company relies on competent and reliable evidence which in some instances must be competent and reliable scientific evidence to support the claims made The proposed order also prohibits Nice Pak from providing the means and instrumentalities to anyone else to make the prohibited misrepresentations The Commission vote issuing the complaint and approving the proposed consent order was 5 0 The FTC will publish a description of the consent agreement package in the Federal Register shortly The agreement will be subject to public comment for 30 days beginning today and continuing through June 19 2015 after which the Commission will decide whether to make the proposed consent order final Comments can be submitted electronically NOTE The Commission issues an administrative complaint when it has reason to believe that the law has been or is being violated and it appears to the Commission that a proceeding is in the public interest When the Commission issues a consent order on a final basis it carries the force of law with respect to future actions Each violation of such an order may

    similar hygiene products the lawsuit homed in on the cost of repairing clogged infrastructure The complaint states Flushable wipes remain intact long enough to pass through private wastewater drain pipes into the municipal sewer line causing clogs and other issues for municipal and county sewer systems and wastewater treatment plants resulting in thousands if not millions of dollars of damages Charmin Freshmates Cottonelle Fresh Care Flushable Wipes and Cleansing Cloths Pampers Kandoo Flushable Wipes and Scott Naturals Flushable Moist Wipes are all mentioned in the suit according to the Star Tribune Here s the industry response as written in the Star Tribune Representatives of the industry behind wet wipes argue that people are flushing cloths that never claimed to be flushable such as cheap baby wipes meant to be bundled in disposable diapers and thrown in the trash That industry has empathy for the challenges the wastewater operators are having with nonflushable materials impacting their systems said Dave Rousse president of the Association of Nonwoven Fabrics Industry a trade group representing manufacturers of wipes and other products However we take great exception to any effort to blame flushable wipes for the problems being caused by nonflushable wipes The lawsuit focuses in part on allegedly false claims made by manufacturers according to Route 50 The suit alleges per the report Despite numerous complaints from state and local sewer authorities both in United States and internationally defendants have not removed the false claims regarding the flushability of these wipes The suit says many cities including Aurora CO Beloit WI New York City and Raleigh NC have faced problems with wipes Beloit Director of Water Resources Harry Mathos says his city s problem has not been severe according to Route 50 But the challenge was significant enough that the city launched a no

  • Associations Collaborate To Launch Improved 'Flushability' Guidelines To Reduce Impacts Of Improper Wipes Disposal
    represents a reasonable framework to which new information and collaborative sharing of technical expertise between the wastewater sector and the nonwoven fabrics industry should be applied to further improve the flushability guidelines The primary goal for the March 26th meeting will be to explore opportunities to increase public and consumer awareness about the proper disposal of the nonwoven wipes products and also to increase the wipes industry s responsibility over downstream impacts of these products The meeting will include wastewater sector representatives as well as the sustainability and marketing leaders of the nonwoven fabrics industry Given the issues associated with non flushable products the group is eager to get started on these key objectives Some nonwoven wipes products are not designed to be flushed but get inappropriately flushed anyway so INDA is working together with NACWA APWA WEF and CWWA to develop improved flushability guidelines and other efforts to help alleviate the problems caused in the wastewater systems said INDA President Dave Rousse As a group the associations would like to see improvement in the labeling of wipes that are not designed to be flushed as well as the development of strategies for a broader consumer education effort about the proper disposal of wipes APWA welcomes the collaborative product stewardship process and the discussions about the products that are commonly flushed and causing problems in wastewater systems said APWA Executive Director Peter B King Public works professionals across North America also welcome the improved labeling of products to educate consumers and reduce the amount of non flushable products in our municipal water systems The intent following the initial product stewardship meeting is for the associations to develop a roadmap for future activities including improved product labeling increased public education and better consumer information regarding product flushability Depending on the directions developed during the product stewardship process the initiative could be expanded to include other consumer products that are commonly flushed and cause problems in wastewater systems such as paper towels feminine hygiene products cotton swabs and other materials NACWA looks forward to working with the wipes industry to help improve consumer awareness about products that should and should not be flushed said NACWA Executive Director Ken Kirk Toilets are not trash cans and reducing the amount of inappropriately flushed products will save utilities millions of dollars each year The burden created by non flushable products for public wastewater utilities must be reduced added WEF Executive Director Eileen O Neill The new flushability guidelines and collaborative efforts to improve product stewardship practices are important steps to reducing negative impacts by improving product design and increasing consumer awareness about what should and should not be flushed About INDA INDA the Association of the Nonwoven Fabrics Industry serves hundreds of member companies in the nonwovens engineered fabrics industry in global commerce Since 1968 INDA events have helped members connect learn innovate and develop their businesses INDA educational courses market data test methods consultancy and issue advocacy help members succeed by providing them the
